Temporary Spouse Visa: Be With The One You Love

The offshore temporary spouse visa (Subclass 309 and Subclass 820) lets you enjoy the company of your partner. This visa for Australia allows you to enter and remain in the country on the basis of your marriage or de-facto relationship with your partner.

Your partner must sponsor you to become eligible for this visa type. He or she must be an Australia citizen, an Australian permanent resident or an eligible New Zealand citizen. Generally, it is also best if you are living with your partner in a spouse relationship at the time of your application.

To acquire this Australian visa, you may be asked to produce evidence of a genuine and continuing relationship. This can include statements or statutory declarations regarding the history of your relationship including how, when and where you first met, how your relationship evolved, when you decided to marry or to start a de facto spouse relationship, your domestic arrangements, any periods of separation and your future plans. The assessing party may look for objective evidence such as proof that you are living together, sharing important financial commitments, setting up household separately and other such things.

Once the temporary spouse visa is granted, there may be a specified initial entry date to which you must comply to. You must all continue to meet all legal requirements under the temporary visa.

The temporary visa works during a waiting period of around two years from the date of application. If after such time, your relationship with your partner is still going strong, you may be eligible for a permanent partner visa. The temporary visa allows you to stay in Australia with your spouse until a decision is made regarding your permanent visa. The temporary and permanent spouse visa can be filed at the same time, under one application.

While holding a temporary spouse visa, you are entitled to work in Australia. You may also study in the country, but you will not have access to government funding for tertiary study. You may benefit from Australias medical schemes and hospital care entitlements such as Medicare.
