What is the 457 Visa? - Information for Employers in Australia

The Temporary Business (Long Stay) subclass 457 visa is one of the most commonly used in the Australia visa program. It this visa enables employers to employ overseas workers to fill nominated skilled positions in Australia for a period between three months and four years.

The Standard Business Sponsorship

Under this 457 visa sponsorship program, the first step for an employer involves applying to be a sponsor. An employer must demonstrate that they are lawfully operating a business that is actively engaged in business activities in Australia.

An employer is also required to have a good business record, abided by immigration laws in the past and satisfy the Training Bench mark.

Once approved Standard Business Sponsors also need to adhere to sponsor obligations to avoid having sanctions imposed.

The Nomination
Once an employer has been approved as an Australian Standard Business Sponsor the employer is then required to nominate the position to be filled by the 457 visa applicant.

The nominated position must relate to an eligible occupation on the Consolidated Skilled Occupation List (CSOL) which can be found here: http://www.nationalvisas.com.au/employer/eligible457visaoccupations.htm

The nominated position must also be remunerated at an equivalent market salary rate and specify the same terms and conditions of employment that would be provided to an Australian who performs the same duties in the same location.

Regardless of the nature of the position, to be eligible under the 457 visa program, the nominated base salary (without superannuation) must not fall below the Temporary Skilled Migration Income Threshold.($54,100)

Lastly, the 457 Visa applicant needs to demonstrate that they have the skills, qualifications and work experience to work in Australia the nominated position.
