Just recently, an announcement was made by the Australian Minister for Immigration and Citizenship regarding its effort on speeding up the Australian visa form processing arrangements ahead of the move to community detention.<span id="more-4323"></span>Under the Australian Government&#8217;s new approach to immigration detention through a better cooperation between the immigration and security agencies, the security assessments and Australia visa form processing for prospective holders of a refugee visa to Australia will be accelerated.<br />
With Australia&#8217;s Refugee and Humanitarian Program, one of the two components of Australia’s Immigration Program, the Australian government will provide protection for asylum seekers who meet the United Nations definition of a refugee, as defined in the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol (Refugees Convention).<br />
These refugees (who are already in Australia) and others in refugee–like situations (outside Australia) will be offered protection and resettlement by the Australian Government.<br />
For refugees who are in Australia and wish to apply for protection or asylum, under the onshore component of the Refugee and Humanitarian program, they can <a href="http://www.nationalvisas.com.au/aboutus/aboutus.htm">apply visa to Australia</a> under only one available visa subclass, the Protection Visa (Class XA) (Subclass 866). While under the offshore component of the Refugee and Humanitarian Program, there are two categories of people who can apply: the Refugee category for people subject to persecution in their home country and the Special Humanitarian Program (SHP) category for people who, while not being refugees, are subject to substantial discrimination amounting to a gross violation of their human rights in their home country.<br />
Under the Australia&#8217;s Refugee and Humanitarian Program, in order to be granted visas Australian, these refugees must first pass the <a href="http://www.nationalvisas.com.au/services/visainformation.htm">Australian visa requirements</a> like character and security checks, required health examinations and sign the Australian Values Statement.<br />
According to Australian Immigration Minister Chris Bowen, between the Department of Immigration and Citizenship (DIAC) and the Australian Security Intelligence Organisation (ASIO), Australia&#8217;s national security service, they have significantly sped up the processing of the vast majority of refugee claims and their security claims.<br />
For the last 12 months, 3,900 visas were already granted to people who&#8217;ve arrived by boat as compared to the 2,600 that have arrived. For the first time, DIAC have been releasing more people from detention as compared to the number of people who are going into detention.<br />
This combined effort of speeding up humanitarian Australia visa processing times comes as Australia makes community detention a more central part of the immigration system.<br />
Earlier this month, Prime Minister Julian Gillard was forced to dump a controversial refugee-swap deal with Malaysia for lack of support. Consequently, the Australian Government had announced that since the Malaysia refugee swap deal was rejected by the Federal Parliament, asylum applicants on Australian soil will now be housed in the community on bridging visas, allowing them to work and live un-detained while their refugee claims are assessed and heard by the appropriate (Australian) authorities.<br />
The Malaysia refugee swap deal was a plan where the Australian government will be able to send 800 asylum seekers to Malaysia for &#8220;processing&#8221; and accept 4,000 already &#8220;processed&#8221; refugees from Malaysia. This swap deal is said to deter would-be asylum seekers from the dangerous journey — usually by leaky, overcrowded boat, provided by Indonesian &#8220;snake-heads,&#8221; or people smugglers — to Australia.<br />
However, Mr. Bowen also made it clear that there will also be some cases where security and other concerns will lead to much longer processing times.</p>

So what is the Pacific Seasonal Workers Pilot Scheme (PSWPS)?<span id="more-4143"></span></p>
<p><strong>Pacific Seasonal Workers Pilot Scheme (PSWPS)</strong></p>
<p>In August 2008, in the lead-up to the 2008 Pacific Islands Forum leaders’ meeting in Niue, the Australian government had lunched what was called the Seasonal Worker Pilot Scheme for the Pacific islands or better known as Pacific Seasonal Workers Pilot Scheme (PSWPS).<br />
PSWPS is designed for Australian employers to get a guaranteed labor force during peak harvest time, while workers have the chance to earn high wages to send home remittances to family and community.<br />
Under the scheme, up to 2,500 visas &#8212; not a Australian work holiday visa nor any of the <a href="http://www.nationalvisas.com.au/working/workingholidayvisas.htm">Australian holiday visas </a>&#8212; were first made available for unskilled workers from Papua New Guinea, Tonga, Kiribati and Vanuatu to work for up to seven months in any 12-month period with horticultural enterprises or farms in Australia who cannot find enough local labor to meet their seasonal harvest needs.<br />
This means that Pacific seasonal workers from Kiribati, Papua New Guinea, Tonga or Vanuatu are recruited to work in Australia’s horticulture industry for up to six months, picking fruit in orchards and vineyards.<br />
In order to be considered eligible to participate in the scheme, workers of participating countries must comply with the scheme’s <a href="http://www.nationalvisas.com.au/services/visainformation.htm">Australian visa requirements</a> such as:<br />
be aged between 21 and 45 at the time of visa application<br />
Be of good character – where applicants will undergo a police record check<br />
be healthy and fit for the work specified<br />
be citizens of the participating country and in the participating country at the time of visa application<br />
have a genuine intention to enter Australia for seasonal work and return to the participating country after their employment ceases<br />
have not participated in the New Zealand Recognized Seasonal Employer (NZ RSE) scheme<br />

Pacific Seasonal Workers Pilot Scheme Expanded</strong></p>
<p>Now, PSWPS participants have been expanded and now include the Pacific countries of Nauru, Samoa, Solomon Islands and Tuvalu.<br />
Aimed to provide Australian producers more avenue to source workers, where seasonal demands outstrip the local supply of labor as well as offer an important economic boost to more communities in Australia’s Pacific neighborhoods, workers from Nauru, Samoa, Solomon Islands and Tuvalu have been invited to join those from Kiribati, Papua New Guinea, Tonga and Vanuatu to participate in the pilot scheme.<br />
Under this pilot scheme, Australian farmers are now allowed to employ workers from certain Pacific Island countries, under special visa conditions different from the conditions set in the work <a href="http://www.nationalvisas.com.au/working/workingholidayvisas.htm">holiday Australia visa</a>.<br />
So far with over 560 workers recruited, the pilot scheme is said to have been delivering benefits to both Australia’s horticulture industry and participating Pacific countries, as these pacific seasonal workers remit money back home, benefiting their families and broader communities and in Australia, the pilot scheme is said to be delivering productivity gains for the horticulture industry, predominantly in regional areas where access to a reliable labor supply has been a longstanding challenge.<br />
As Australia’s horticulture industry recovers from the severe drought and floods as well as following the introduction of more flexible arrangements by the Australian Government in December 2010, the demand for Pacific seasonal workers by the horticulture industry is increasing.</p>

<p style="text-align: justify;">Just last month, news regarding the tough new immigration rules for foreign students hitting Australia&#8217;s economy has been circulating in the internet. The news said that more than 125,000 fewer international students are expected to come in the next 12 months that would cost more than 31,000 jobs nationwide.<br />

The report also said that a confidential Immigration Department figures has revealed that with the new visa Australian applications, it has suggested that Victoria, the state that is most reliant on foreign students, will be hit the hardest, with 40,250 fewer <a href="http://www.nationalvisas.com.au/student/studentvisas.htm">student visa Australia</a> applicants in the next year.<br />
The figures show that a drop of 47 percent in the number of visa applications from India alone was being observed in the nine months to the end of March.<br />
Prior to the changes were announced, international education was reported to be a $17 billion industry nationally and had brought Victoria and annual income of $4 billion.<br />
The Cause<br />
According to an education expert, fewer overseas students, including from India, will be able to obtain skilled migrant visas which is said to be blamed on the basis of their Australia qualifications which is said to be under tough new migration rules.<br />
Last February, Immigration Minister Chris Evans had announced changes on its migration rules which made it tougher for students to obtain a study visa, as well as attacked overseas student’s ability to gain permanent residency after graduation.<br />
Likewise, just last May, the Immigration minister has again announced a new alternative English language tests for Student visas. Now, the Test of English as a Foreign Language (TOEFL), the Pearson Test of English Academic (Pearson) and the Cambridge English: Advanced (CAE) from Cambridge ESOL (Cambridge) have become acceptable tests for Student visa application purposes.<br />
According to Monash university researcher, Bob Birrell, this new change will greatly favor overseas applicants from English-speaking countries who can easily meet the much tougher English language requirements of the new points test.<br />
Moreover, the band score of 7 in IELTS examination, with regards to English, has now been made compulsory. This further made English language requirement more difficult.<br />
Likewise, a number of popular courses, such as hairdressing and cookery have been removed from the Skilled Occupations List, which determines which occupations are eligible for independent or unsponsored skilled migration.<br />
Furthermore, the newly implemented skilled migration points test last July 1 is said to have weakened the policy link between education and migration.<br />
The Result<br />
The Australian government has made it more difficult for overseas students to acquire student visas. With these tougher new immigration policies, it has increased the level of uncertainty for student visa applicants.<br />
Potential students have lost faith in the Australian market. The lost in faith has greatly impacted the entire international education market. A slowdown from China was being observed, with India dropping significantly, as well as drops from other key markets, Vietnam, Malaysia, and Korea.<br />
Potential students are now applying to Canada, Britain or the United States instead.<br />
With these drop in the overseas student visa application, a call for student visa flexibility has been ringing for quite some time.</p>
