In Australia, visas can be sponsored by either employers or eligible individuals. Employers can take part in the Employer Nomination Scheme. To do so, they must be actively and lawfully operating a business in Australia.
The employer must also follow all relevant Australian laws and have a satisfactory record of meeting migration laws (if they’ve sponsored employees for an Australia visa before). The position must be for paid employment and should be genuinely needed for their business. They must provide the employee with an offer of permanent employment. The employer must also have a current training strategy if they are an existing business or a training plan for a newly established business.
The position itself has to be for full-time employment, should be on-going and must be available for at least 3 years. Working conditions for this opening should be favourable under relevant Australian legislation. For an employer to be able to nominate a position for a sponsored Australian visa, it should be included in the highly skilled occupation list. There are also minimum salary level requirements for ENS.
Eligible individuals can also sponsor for an Australia visa. An example of one type of visa that allows this is the Sponsored Family Visitor visa or subclass 679. The sponsor must be an Australia citizen or a permanent resident, he or she must be aged 18 or above and should have been settled in Australia for a reasonable amount of time (usually 2 years). Depending on the Australian visa type, the sponsor must also be either a relative, a member of the Australian parliament (Commonwealth, State or Territory), an authorised person representing a Commonwealth, State or Territory or a local government mayor.
For other visa types, relationships such as fiance, same sex partner, cousins or fiends can also sponsor for an Australian visa. Special Category visa holders, eligible New Zealand citizens, New Zealand citizens and New Zealand permanent residents are also allowed to sponsor for some Australian visa types.
